Terms and Conditions – The Goofy Studio

Introduction: These terms and conditions apply to all agreements and transactions between The Goofy Studio and its customers. By placing an order, the customer agrees to these terms.

1. Definitions:

  • Customer: The natural or legal person who enters into an agreement with The Goofy Studio.
  • Products: All clothing items and accessories offered by The Goofy Studio.
  • Agreement: The purchase agreement between The Goofy Studio and the customer.

2. Applicability: These terms apply to all offers, orders, and agreements of The Goofy Studio. Deviations are only binding if agreed upon in writing.

3. Prices and Payment:

  • All prices are stated in euros and include VAT.
  • Payment can be made via iDEAL or credit card.
  • Payment must be made within 14 days of the invoice date, unless otherwise agreed.
  • The Goofy Studio reserves the right to adjust prices.
  • Any collection costs due to late payment are at the customer’s expense.

4. Delivery and Shipping:

  • Products are shipped to the address provided by the customer.
  • Delivery time is approximately 3-5 business days after receipt of payment.
  • Shipping costs are specified separately during the order process.
  • The risk of loss or damage of products transfers to the customer upon delivery.
  • Deliveries outside the Netherlands may have different delivery times and costs.
  • Non-deliverable products will be refunded within 14 days.

5. Returns and Exchanges:

  • The customer has the right to withdraw from the agreement within 14 days of receiving the product.
  • Return shipping costs are at the customer’s expense, unless the product is delivered defective.
  • Returned products must be returned in their original condition and packaging.
  • Upon exchange or return, the purchase amount will be refunded within 14 days after receipt.
  • Products purchased during promotions or with discount codes may be excluded from returns.

6. Warranty and Complaints:

  • The Goofy Studio offers a warranty period of two months after the purchase date on all products.
  • Complaints must be reported in writing within 7 days after discovery via support@goofclothing.eu.
  • The Goofy Studio aims to respond to complaints within 14 days.

7. Force Majeure:

  • The Goofy Studio is not liable for delays or damages resulting from force majeure, including strikes, fire, natural disasters, pandemics, or government measures.

8. Limitation of Liability:

  • The Goofy Studio is not liable for indirect damage, consequential damage, or loss of profit.
  • The liability of The Goofy Studio is limited to the invoice amount of the respective order.

9. Promotions and Discount Codes:

  • Discount codes are only valid once and cannot be combined with other offers.
  • Discount codes are not exchangeable for cash.
  • The Goofy Studio reserves the right to modify or cancel promotions without prior notice.

10. Pre-orders and Delivery Times:

  • Pre-orders are subject to different delivery times, which will be communicated per product.
  • Pre-orders cannot be canceled unless agreed upon in writing.

11. Dispute Resolution:

  • Dutch law applies to all agreements.
  • Disputes are preferably resolved amicably.
  • If no agreement is reached, the dispute will be submitted to the competent court in the district of The Goofy Studio's place of business.

12. Changes to the Terms:

  • The Goofy Studio reserves the right to amend these terms.
  • Customers will be notified of changes via the website or email.
  • The most recent version of the terms and conditions is always available on the website.

13. Privacy and Data Protection:

  • The Goofy Studio processes personal data in accordance with the privacy policy (see GDPR document).
  • Customers can exercise their rights as described in the privacy policy.

14. Intellectual Property:

  • All designs, images, and texts on The Goofy Studio’s website are the property of The Goofy Studio and may not be used without permission.
